These Terms of Service ("Terms") govern your use of Indigify's marketplace platform and services. By accessing or using our platform, you agree to be bound by these Terms. Our platform is dedicated to supporting Indigenous artisans and preserving traditional cultural practices while fostering economic sovereignty within Indigenous communities.
Acceptance of Terms
By creating an account, making a purchase, or using any part of our platform, you confirm that you have read, understood, and agree to these Terms. If you do not agree with any part of these Terms, you must not use our platform. These Terms may be updated periodically, and continued use of the platform constitutes acceptance of any changes.
Platform Use
Permitted Use
- Browse and purchase authentic Indigenous products
- Create an account for order tracking and communication
- Leave respectful reviews and feedback
- Share cultural knowledge and appreciation responsibly
Prohibited Activities
- Cultural appropriation or misrepresentation of Indigenous culture
- Selling counterfeit or inauthentic Indigenous products
- Harassment or disrespectful behavior toward vendors or other users
- Violation of intellectual property or traditional knowledge rights
- Use of the platform for illegal activities or fraud
- Attempting to circumvent security measures or access restrictions
Vendor Requirements and Cultural Authenticity
Vendors on our platform must meet strict authenticity requirements to ensure cultural integrity:
- Proof of Indigenous heritage and tribal/nation affiliation
- Verification of authenticity for all cultural products
- Respect for sacred and ceremonial items (some items may be restricted)
- Accurate representation of cultural significance and traditional methods
- Compliance with traditional knowledge and intellectual property protocols
- Commitment to supporting Indigenous community economic development
Account Responsibilities
- Provide accurate and current information when creating an account
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized account access
- Take responsibility for all activities under your account
- Comply with all applicable laws and cultural protocols
- Respect the intellectual property and cultural rights of others
Purchases and Payments
All purchases are subject to availability and acceptance. Prices are displayed in Canadian dollars and include applicable taxes where required. Payment processing is handled securely through third-party providers.
We reserve the right to refuse orders that we reasonably believe may involve fraud, cultural appropriation, or violation of these Terms. In such cases, we will provide a full refund if payment has been processed.
Shipping and Returns
Shipping times and costs vary by vendor location and product type. Each vendor sets their own shipping and return policies, which are clearly displayed on product pages. Custom or ceremonial items may have different return restrictions due to their cultural significance.
Returns must respect the cultural nature of Indigenous products. Sacred or ceremonial items may not be returnable for cultural reasons, which will be clearly indicated at the time of purchase.
Intellectual Property and Cultural Rights
We respect Indigenous intellectual property rights, traditional knowledge, and cultural heritage. All product designs, traditional patterns, and cultural knowledge remain the property of their respective Indigenous creators and communities.
Users are prohibited from reproducing, copying, or appropriating Indigenous designs, traditional knowledge, or cultural elements without proper authorization and respect for cultural protocols.
Platform Availability
While we strive to maintain continuous platform availability, we do not guarantee uninterrupted access. We may temporarily suspend service for maintenance, updates, or technical issues. We are not liable for any losses resulting from platform unavailability.
Limitation of Liability
Indigify acts as a marketplace platform connecting buyers with Indigenous vendors. We are not responsible for the quality, authenticity (beyond our verification process), safety, or legality of products sold by vendors. Our liability is limited to the maximum extent permitted by law.
Privacy and Data Protection
Your privacy is important to us, especially regarding Indigenous data sovereignty. Please review our Privacy Policyto understand how we collect, use, and protect your personal information in accordance with Indigenous data governance principles.
Dispute Resolution
We encourage resolving disputes through respectful dialogue and community-based approaches when possible. For purchase-related disputes, we provide mediation services between buyers and vendors.
Any legal disputes will be governed by the laws of Canada and the province of Ontario, with consideration for Indigenous legal traditions and cultural practices where applicable.
Account Termination
We reserve the right to suspend or terminate accounts that violate these Terms, engage in cultural appropriation, or harm our community. Users may also close their accounts at any time by contacting customer support.
Upon termination, your access to the platform will cease, but these Terms will continue to apply to past activities and any outstanding obligations.
Changes to These Terms
We may update these Terms periodically to reflect changes in our services or legal requirements. Significant changes will be communicated via email or prominent notice on our platform. Your continued use of the platform after changes indicates acceptance of the updated Terms.
